Distance Sales Agreement

1. Parties

This Distance Sales Agreement (“Agreement”) is made between:

Seller: Mode du Jour Men's Wear

Buyer: The person placing an online order through our website, social media platform, or by any other electronic means.

2. Scope of Agreement

This Agreement applies to all purchases made without physical presence between the Seller and the Buyer — including orders placed through the Seller’s online store, Instagram, Facebook, or WhatsApp, in accordance with the latest Consumer Protection Act of Mauritius.

By placing an order and receiving confirmation, the Buyer agrees to the terms outlined below.

3. Product Information

All product descriptions are provided by the Seller. Video calls and on-site photos may also be used to present the items.

While the Seller strives for accuracy, slight variations in colour, size, or fit may occur due to lighting, display settings, or fabric characteristics.

4. Prices and Payment

All prices are in Mauritian Rupees (MUR) and include VAT (if applicable).
Payment methods accepted: [Juice, Scan to pay]
The order is considered confirmed once full payment is received.

5. Delivery

Goods will be posted to the address provided by the Buyer.
Delivery timeframes will depend on post office schedules and may vary based on location or public holidays.

The Seller shall not be liable for delays due to force majeure or extraordinary circumstances that prevent transportation.

6. Return / Exchange Policy

Items once purchased cannot be refunded.
They may only be exchanged, subject to the following conditions:

  • Exchange is dependent on availability of stock for the same item.

  • If the item is out of stock, it may be exchanged for another product of equal value.

  • Buyer must notify the Seller within 24 hours from the delivery time.

  • The Buyer must bring the item to the St Pierre shop within 7 days from delivery, along with the receipt.

  • Returned products must be unused, unwashed, unaltered, and in their original packaging with all tags attached.
    Failure to comply with the above conditions will result in rejection of the exchange request.

7. Order Confirmation and Withdrawal

  • All purchases made are instant-buy transactions.

  • Once payment is confirmed, the order is considered final and binding.

  • The Seller does not reserve or hold items for later confirmation or payment.

  • Orders cannot be cancelled or withdrawn once confirmed, except when:

    • The item is defective, or

    • The product is unavailable or out of stock.

  • Exchanges are allowed only under the Exchange Policy stated above.

8. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy

9. Liability

The Seller’s liability is limited to the value of the goods sold.
The Seller shall not be held responsible for indirect losses, delays caused by couriers, or misuse of items by the Buyer.

10. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Mauritius.
Any dispute arising shall fall under the Customer Protection Act.

11. Acceptance

By placing an order online and completing payment, the Buyer acknowledges having read, understood, and accepted. This Distance Sales Agreement enters into force by being approved electronically.
